2.231 Compliance with Rules of School Board

All rules adopted by the School Board, and included herein, shall be binding on all persons subject to the jurisdiction of the Board.

I. Failure or refusal of an employee to carry out any duties and responsibilities assigned by School Board policy, state administrative rule, or state statute or the failure to otherwise adhere to the terms, conditions, or requirements, imposed by such policy, rule, or statute shall be grounds for disciplinary action, including suspension or dismissal when appropriate

II. A teacher who believes they have been directed by their school district or school to violate general law or state board rules, may request that the Commissioner of Education appoint a special magistrate who is a member of The Florida Bar in good standing and who has at least 5 years’ experience in administrative law to determine facts relating to the dispute over the school district procedure or practice, consider information provided by the teacher and the school district, and render a recommended decision. The requested special magistrate process shall conform with Florida Statute 1015.06 and FAC 6A-1.094127, as amended from time to time.
